End User Licence Agreement β The Paving Stone Pros App
1. About this agreement
By signing in to or using The Paving Stone Pros field-management app (the "App"), you agree to these terms. If you use the App for a company, you confirm you have authority to bind that company, and "you" means the company and its users.
The App is provided by The Pavingstone Pros operating as The Paving Stone Pros, 92 Arnold Ave, Winnipeg, Manitoba ("we", "us"). If you do not agree, do not use the App.
Effective date: November 2, 2026.
2. Definitions
- Company: the business that licenses or operates the App, including The Paving Stone Pros for its own use.
- User: a person given an account by a Company admin (admin, estimator, foreman or crew).
- Customer: a client of the Company who uses the client portal to view quotes, sign contracts, pay or send messages.
- Your Data: everything you or your Customers put into the App: contacts, projects, quotes, invoices, time logs, photos, files, messages and signatures.
- Third-Party Services: services the App connects to but we do not control, such as QuickBooks Online, Google Gemini, Supabase, Render and email providers.
3. Licence and restrictions
We grant you a non-exclusive, non-transferable licence to use the App for your own business's internal operations. The licence covers one Company and its own Users; it is not a sale of the software.
You must not:
- resell, sublicense, rent or share the App with another business;
- copy, modify, decompile or reverse-engineer it, except where the law allows despite this term;
- remove our notices or branding, except branding we let you replace with your own;
- use it to break the law, send spam, or store content you have no right to use;
- try to get around security, access data you are not entitled to, or overload the service.
We and our licensors keep all rights in the App not expressly granted here.
4. Accounts and access
Accounts are by invitation only. A Company admin invites each User and chooses their role, which controls what they can see and change.
- Keep your password private and use at least 8 characters. Tell your admin right away if you think your account was used without permission.
- Admins are responsible for who they invite, the roles they assign, and removing access when someone leaves.
- You are responsible for everything done under your account.
- We may suspend an account that breaks these terms or puts the App or other users at risk.
5. Your Data, the client portal and e-signatures
You own Your Data. You give us permission to host, process and back it up only as needed to run the App for you, and to fix problems you report.
- Your responsibility. You must have the right to collect and store your Customers' and staff's information, and you must follow privacy law (in Canada, PIPEDA and any provincial law that applies) when you use it.
- Client portal. Customers reach the portal through a private link. Anyone with the link can see that project, so send links only to the right person.
- E-signatures. When a Customer signs a quote or contract, the App records the typed name, date and time, IP address and the exact contract wording. This record is evidence of the signature; you decide whether an electronic signature suits each contract.
- Contract wording. The contract terms in the App are yours. We do not provide legal advice and are not responsible for the content of your contracts.
6. Third-Party Services
The App relies on Third-Party Services, each under its own terms. We are not responsible for their availability, changes or errors.
| Service | What it does in the App |
|---|---|
| Supabase | Database, sign-in and file storage |
| Render | Runs the App's server |
| Google Gemini | AI estimator and assistant |
| Email provider (SMTP) | Sends invoices, invites and notifications |
| Intuit QuickBooks Online | Optional accounting sync |
QuickBooks. Connecting QuickBooks is optional and done by an admin through Intuit's own sign-in. The App only sends an invoice or payment to QuickBooks when an admin presses "Send to QuickBooks"; nothing is sent automatically. You can disconnect at any time from Settings, which deletes the stored connection tokens. Your use of QuickBooks is governed by Intuit's terms, and Intuit is not a party to this agreement.
7. Check before you rely on it
The App helps you work faster, but you remain responsible for every price, tax, date and payroll figure you use.
- AI suggestions. The AI estimator and assistant can be wrong. They only propose changes; nothing is saved until a User reviews it and presses Apply.
- Taxes. The App applies the GST, PST or HST codes you choose. Confirm rates and which tax applies with the CRA, your province or your accountant.
- Time and payroll. Time logs, lunch deductions and wage totals depend on your settings. Verify them against Manitoba Employment Standards (or your province's rules) before paying anyone.
- Schedules and weather. Scheduling and date calculations are estimates based on your work-day settings.
8. Fees, updates and support
Fees for a licence, setup and any yearly update plan are set out in your purchase agreement or invoice. Fees paid are non-refundable except where that agreement or the law says otherwise.
- Your own accounts. You pay for and manage your own Third-Party Services (hosting, database, email, AI, QuickBooks, text messaging).
- Updates. While an update plan is active, we provide bug fixes and improvements we choose to release. Without one, the App keeps working as delivered but receives no updates.
- Support. Support is by email at adam@pavingstone.pro or as your purchase agreement states.
- Availability. We aim to keep the App running but do not promise it will be uninterrupted or error-free. Outages at a Third-Party Service can make the App unavailable.
- Backups. Keep your own exports or backups of important records.
9. Warranty, liability and indemnity
The App is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
- Limit on liability. Our total liability for any claim about the App is limited to the fees you paid us in the 12 months before the claim.
- No indirect losses. We are not liable for lost profits, lost data, business interruption, or indirect or consequential losses, even if we were told they were possible.
- Your indemnity. You will cover our reasonable costs from claims by your Customers, staff or others arising from Your Data, your contracts, or your breach of these terms.
Nothing here limits liability that cannot be limited by law, such as for fraud.
10. Ending the agreement, governing law and contact
This agreement lasts while you use the App. You can stop at any time. We may end your licence if you seriously breach these terms and do not fix the breach within 30 days of notice.
- Your Data at the end. Before access ends you can export your records. On request we will help you export or delete Your Data, except what we must keep by law.
- Governing law. These terms are governed by the laws of Manitoba and the federal laws of Canada that apply there. Disputes go to the courts of Manitoba.
- Changes. We may update these terms. We will post the new version with a new effective date and, for major changes, tell admins by email. Continuing to use the App means you accept the update.
- Whole agreement. These terms, your purchase agreement and our Privacy Policy are the whole agreement. If one part is unenforceable, the rest still applies.
